Malaysia Among Countries Worldwide Posting Double-digit Growth In IP Filings

Malaysia is one of the four Asean member states to register double-digit growth in intellectual property (IP) filings.

The others are Singapore, the Philippines and Vietnam.

Colombia, Russia and Ukraine also posted double-digit IP filings.

Intellectual property filings rose significantly worldwide in 2010, underscoring global innovation initiatives driven mainly by the United States and China despite the global economic crisis, according to the latest report released by the United Nations World Intellectual Property Organisation (WIPO).

The report provides an indication of strong growth in intellectual property filings worldwide in 2010 despite the global economic crisis plaguing advanced nations and developing countries.

The report highlights the strong rebound in IP filings after the 2009 slump.

Patent application filings were 7.2 per cent higher in 2010 over the previous year. This was the highest growth rate in five years compared to a 3.6 per cent decline in the previous year.

WIPO director-general Francis Gurry said the increase in IP filings showed companies across the globe have continued to innovate despite the difficult economic conditions.

“This can help create new jobs and generate prosperity once macro-economic stability is restored,” he said in the report’s foreword.

Gurry also cautioned that “if economic conditions were to deteriorate sharply in the short term as happened in 2009, companies might be forced to abandon their investments in innovation, stifling an essential source of growth.”

Total number of patent applications worldwide rose by 7.2 per cent, reaching 1.98 million, while trademark filings increased by 11.8 per cent, touching 3.66 million, both all-time high figures according to WIPO.

Computer technology, electrical machinery, audio-visual technology and medical technology accounted for the largest share of patent filings worldwide.

Patent and Trademark Infringement Case

A technology and services leader in interactive media marketing, on Thursday announced that the U.S. District Court of New York reactivated its patent and trademark infringement case against AOL, Time Warner and Platform-A. The case was filed in 2009.

AUGT said that Hon. Judge Sweet of the U.S. District Court in New York scheduled a pretrial conference for January 25, 2012 for the case. AUGT had filed the lawsuit alleging that AOL, Time Warner and Platform-A are infringing on U.S. Patent No. 6,594,691 and U.S. Patent No. 7,269,636.

Augme Technologies also claimed that AOL infringed on its trademark. The company is seeking injunctive relief and as yet unspecified damages from the alleged infringement.

Trademark Database

The Domestic Trade, Cooperatives and Consumerism Ministry launched a database system today, called the “Basket of Brand” (BOB), which will facilitate the listing of registered trademark owners.

Minister Datuk Seri Ismail Sabri Yaakob said the database would be used in detecting trademark infringements including those related to copyright, and in prosecuting the offenders.

Through the database, he said, the ministry would be able to prioritise on the investigations and seizure of items if the trademark owners agree to appear in court and help the prosecution prove copyright infringement.

Prior to this, he said, the ministry had problems in getting a conviction in such cases because trademark owners were unable to show proof of trademark ownership.

“Trademark owners should come forward to identify the infringed items and show proof of ownership,” he said when opening the Intellectual Property Enforcement Convention at Kuala Lumpur Convention Centre, here.

Malaysia Likely To Join Madrid System Of Trademark

The World Intellectual Property Organisation (WIPO) says Malaysia is likely to join the Madrid system of trademarks within one year.

WIPO’s Director General Dr Francis Gurry said it is important for Malaysia to join the system as it give access for local enterprises into foreign markets for goods and services.

“A trademark provides a commercial identity for products and the system is to protect that identity in foreign markets,” he told reporters after a luncheon hosted by the Malaysian Intellectual Property Association, here Tuesday.

Gurry was in Malaysia on a working visit to discuss cooperation between the government and WIPO, including organising an event on the international trademark system, as Malaysia has decided to join the Madrid system.

Domestic Trade, Cooperatives and Consumerism Minister Ismail Sabri had said on Monday that Malaysia is geared to accede to the protocol by 2013 and towards this end, the Ministry is in the process of amending the various IP legislations

Gurry said Malaysia needs to join the Madrid system because the country’s local enterprises filed 1,800 trademark application overseas, with most in countries which are already members of the system.

Among the advantages of the Madrid system are administration costs such as translation of the list of goods and services and representative fees being less compared to several filings in national territories.

Other advantages include managing a trademark portfolio registered through the Madrid system. For example, a change in ownership and licensing, is more cost-effective.

KUALA LUMPUR, Oct 17 (Bernama) — Malaysian small-and-medium enterprises (SMEs) have been urged to register with the Madrid Protocol System which offers trademark protection in over 80 countries with just one application in one language and one currency.

Domestic Trade, Cooperatives and Consumerism Minister Datuk Seri Ismail Sabri Yaakob said Malaysian SMEs can use this system to expand their products and services locally and internationally at reduced costs of filing and maintenance.

“The standardised and harmonised formality requirements and fee structures provided by the Madrid system reduce the fee for international registration thus encouraging more local trademark Malaysia as well as overseas,” he said.

The Madrid System offers trademark protection with a single application with the International Bureau (through the home country office) in one language (English, French or Spanish) and one set of fees.

Ismail Sabri said Malaysia is geared to accede to the protocol by 2013.

“The Ministry is in the process of amending the various IP legislations such as the Patents Act and the Industrial Designs Act, which are expected to be tabled in Parliament in 2012 while the amendment to the Copyrights Act has been passsed recently at the Lower House,” he told reporters at the launch of the National Seminar on the Madrid Protocol at a hotel here.

He said trademark owners from various industries are currently applying for the Madrid Protocol System’s protection.

India : CGPDTM moves to overhaul Trademark regime

The CGPDTM has invited comments from the public on reviewing the organisational structure of the office of the controller general of patent, industrial design, trademark and geographical indications (CGPDTM) to make it more responsive to the needs of Intellectual Property (IP) holders and users while
enhancing the effectiveness and efficiency of its operations.

The department of industrial policy and promotion (DIPP), in a a discussion paper, said that given the radically different skill requirements of trademark and patent office staff, the operational difficulties and the present challenges being faced by CGPDTM and raised the question whether it was important to establish an independent office for the trademarks and geographical indications registry.

Berjaya Books Sdn Bhd, the operator of Borders Malaysia, now owns the Borders Trademark Malaysia in perpetuity within Malaysia following the successful acquisition of the brand.

The company said its parent company, Berjaya Corporation Bhd (BCorp) had acquired the licence to use Border’s trademark on a perpetual basis from the liquidators of Borders Group Inc., USA.
